Fatal accident case sent to circuit

ESCANABA - A 31-year-old Gladstone motorist - arrested in connection with the death of a 73-year-old pedestrian last year - was bound over from Delta County District Court to circuit court this week.

Paul Leonard McCarty, of 1013 Superior Ave., Gladstone, was arrested this summer following investigation into the death of Kenneth Rogus who was struck by McCarty's pickup truck a year ago.

Rogus, of downstate Oxford, was walking along New Welsey Bay Road in Bay de Noc Township when the accident occurred on the morning of Sept. 27, 2012. Michigan State Police from the Gladstone Post responded to the 8:15 a.m. emergency call.

Following investigation into the accident, which included a report by the state police traffic crash reconstructionist, McCarty was later arrested in June. He posted a $2,000 cash bond and was released from police custody.

According to court records, McCarty was arraigned in district court on one count of operating a motor vehicle while his drivers license was suspended, revoked, or denied causing death. The felony carries a maximum penalty of 15 years in prison and a $10,000 fine.

The case was forwarded to circuit court on Wednesday. No date has been set in circuit court where McCarty may be scheduled to make a plea or go to trial.
